The record, however, clearly shows that the judge was in error in concluding that the alleged agreement as to conditional payment of the note was not made at the time of its execution but at a prior date. It is true that in the course of Douds opening statement he did say that the agreement of the parties to the note as to conditional payment was made before the note was executed; but he also said just as clearly and emphatically, and repeated the statement, that the agreement as to the conditional payment of the note was made at the very time the note itself was executed.
